It is not a credit rating service, an ESG rating service, investment advice, financial advice, or a substitute for professional judgement. Outputs are generated based on information provided by the registered entity and platform rules in effect at the time.

1. About These Terms

These Terms of Use (“Terms”) govern your access to and use of this platform (the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

2. Operator

The Platform is operated by Resilient Sustainance Limited, registered in England & Wales (Company No. 16530947) (“Operator”, “we”, “us”, “our”).

3. Eligibility & Authorisation

You may use the Platform only if:

  • you are an authorised representative of the entity you register;
  • you provide accurate and current information; and
  • you comply with these Terms and applicable laws.

Misrepresentation of legal identifiers, unauthorised registration, or attempts to access another entity’s data may lead to suspension or termination.

4. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. You must notify us promptly if you suspect unauthorised access. We may implement access controls, verification gates, and audit logs to protect the Platform.

5. Acceptable Use

You agree not to:

  • submit false, misleading, or unlawful information;
  • probe, scan, or test the vulnerability of the Platform or attempt to bypass access controls;
  • introduce malware, automate abusive traffic, or disrupt Platform operations;
  • copy, scrape, reverse engineer, or attempt to derive source code or proprietary logic except to the extent permitted by law;
  • use Platform outputs to market them as a third-party “rating” or imply regulatory endorsement.

6. Diagnostic Outputs & Limitations

The Platform provides diagnostic scores, maturity labels, and summaries that are:

  • generated from the inputs you provide and platform logic;
  • intended for internal decision-support and improvement planning; and
  • not a statement of financial performance, creditworthiness, investment suitability, or compliance certification.

You acknowledge that inaccurate or incomplete inputs may produce inaccurate outputs. You remain responsible for decisions taken based on Platform outputs.

7. Intellectual Property

The Platform, including its diagnostic methodology, scoring logic, content, design, trademarks, and generated certificate-style outputs (excluding your submitted data), are owned by or licensed to the Operator and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Platform for your internal business purposes during your authorised access period.

8. Your Data

You retain rights to the information you submit, subject to the Operator’s rights to process it to provide and secure the Platform. Details on how we process personal data are described in our Privacy Policy.

9. Suspension & Termination

We may suspend or terminate access (with or without notice) if we reasonably believe that:

  • you violated these Terms;
  • your use poses a security, legal, or operational risk; or
  • information submitted is materially false or unauthorised.

Where practical, we may provide a reason and a pathway to remediate, but we are not obliged to do so in cases of misuse or security risk.

10. Disclaimers

The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of vulnerabilities.

11. Limitation of Liability

To the maximum extent permitted by law, the Operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, business opportunity, or data, arising out of or related to your use of the Platform or reliance on outputs. Where liability cannot be excluded, it will be limited to the minimum amount permitted by law.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms or the Platform.
